Somerset man ordered to cease business

NEW LEXINGTON - A Somerset man is required to end his business after customers accused his company of taking money but never providing the promised work.

David Lee Marsh Sr. operates under the names David’s Mobile Home and Well Service, DM Mobile Home Transport and David’s Mobile Home Transport and Repair, offering mobile home transport and repair services to consumers throughout the state, according to a release from Ohio Attorney General Mike DeWine.

According to an agreed permanent injunction filed Thursday with Perry County Common Pleas Court, Marsh is prohibited from soliciting customers either directly or indirectly for mobile home transport and repair services as well as engaging in consumer transactions involving mobile home transport and repair services.

Marsh also is required to cancel his registered trade name "David's Mobile Home and Well Service" with the secretary of state within 30 days of signing the agreement.

In the past few years, dozens of consumers complained about Marsh’s company, the release from DeWine stated. Most said that after they paid, the company never provided the promised work or did an incomplete, late or shoddy job.

In February 2015, DeWine filed a lawsuit against Marsh for violations of Ohio’s Consumer Sales Practices Act. In October, Marsh agreed not to violate the law and to pay consumer restitution and a civil penalty. After the agreement, however, more complaints were reported against the company.
