Grand jury indicts man accused of sex with minor

CHILLICOTHE – A Ross County grand jury has indicted a man accused of having sex with a 13-year-old girl twice within a month.

Timothy D. Arthur, 22, 51 Blain Highway, Waverly, was indicted Friday on two fourth-degree felony counts of unlawful sexual conduct with a minor.

The victim’s mother alleged her daughter went to take out the trash March 5 in the 2100 block of Anderson Station Road and did not return for some time, according to the Ross County Prosecutor’s Office. When the woman called her daughter, the victim reportedly told her Arthur had had sex with her.

Investigators were later told by the victim it was the second time Arthur allegedly had initiated sexual activity. The other instance was reported to have been sometime between Feb. 15 and Feb. 28.

In other open indictments:

•Owen L. Green, 44, 520 Morse St., Waverly, was indicted on one second-degree felony count of felonious assault and one fourth-degree felony count of domestic violence after a female victim alleged Green fractured her leg in six places, requiring surgery, March 7 at a bar on Blain Highway. Green was indicted with the fourth-degree felony count because he has a prior domestic violence conviction in Sidney.

•Darell L. Netter, 19, 814 Madison Ave., was indicted on one fourth-degree felony count for trespass in a habitation when a person is present of likely to be present. The victim in the case alleges Netter, who she had been dating off and on, broke into her mother’s home and attempted to assault her Jan. 27 in the first block of Hildegarden Street. Police located the victim outside of the residence as she was attempting to get away from Netter, according to the prosecutor’s office.

•Lagenna I. Knight, 25, 893 Columbus St., was indicted on one fourth-degree felony count of improper handling of a firearm in a motor vehicle and another fourth-degree felony count of receiving stolen property. Knight is alleged to have been the passenger in a vehicle that was pulled over March 8 on East Main Street. Knight reportedly told police she had a 9 mm handgun under the passenger seat, and officers reported finding a loaded gun registered to another person and reported stolen from Waverly in 2007.

•Daniel D. Darlington, 44, 422 N. Evans St., Greenfield, was indicted on one first-degree misdemeanor count of assault from a Feb. 15 incident. Darlington is alleged to have called a female victim from her home. When the woman and her son arrived, an altercation occurred between Darlington and the victim’s son.
